TO THE FULLEST EXTENT PERMITTED BY APPLICABLE17 LAW, HELATV.LK DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT,18 AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.19

HELATV.LK DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT20 AVAILABLE THROUGH THE SERVICES.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HELATV.LK, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE21 DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES22 OR THE CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF HELATV.LK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF HELATV.LK TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS AND USE OR YOUR USE OF THE SERVICES EXCEED THE AMOUNT PAID BY YOU (IF ANY) TO HELATV.LK FOR THE SERVICES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

10. Indemnification

You agree to indemnify, defend, and hold harmless helatv.lk, its affiliates, directors, officers, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or23 fees (including reasonable attorneys' fees) arising out of or relating to your breach of these Terms and24 Use or your use of the Services.

11. Governing Law and Dispute Resolution

These Terms and Use shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka, without regard to its conflict of law principles.25 Any dispute arising out of or relating to these Terms and Use or the Services shall be subject to the exclusive jurisdiction of the courts located in Colombo, Sri Lanka.

12. Entire Agreement

These Terms and Use, together with our Privacy Policy and any other legal notices published by us on the Services, constitute the entire agreement between you and26 helatv.lk concerning the Services and supersede all prior and contemporaneous communications and proposals, whether oral or written.

13. Severability

If any provision of these Terms and Use is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

14. Waiver

No waiver of any provision of these27 Terms and Use shall be deemed a further or continuing waiver of such provision or any other provision, and our failure to assert any right or provision under these Terms and Use shall not constitute a waiver of such right or provision.
